Consumer right to exchange products of good quality

The consumer has the right within fourteen calendar days from the date of transfer of a non-food product to him, if the seller has not announced a longer period, to exchange the purchased product at the place of purchase or other places declared by the seller for a similar product of a different size, shape, size, style, color or configuration , producing, in case of a price difference, the necessary recalculation by the seller.


The requirement of the buyer to exchange or return the goods must be satisfied if the goods were not in use, its consumer properties are preserved and there is evidence of its acquisition from this seller.


The list of goods that cannot be exchanged on the grounds specified in this article is approved by the Government of the Republic of Tajikistan.


If a similar product is not on sale on the day the consumer contacts the seller, the consumer has the right to return the purchased product to the seller and receive the sum of money paid for it.


Replacement of goods of inadequate quality


If a consumer finds defects in a product and demands a replacement of such goods, the seller (manufacturer) is obliged to replace such goods immediately and, if necessary, further check the quality of such goods by the seller (manufacturer) to replace them within fourteen calendar days from the date of presentation of the said requirement. In the absence of the seller (manufacturer) required to replace the goods, on the day of filing this requirement, the seller (manufacturer) must replace such goods within a month from the date of filing the specified requirement. If the seller (manufacturer) does not have a product of this model (brand, type, article number, etc.), for reasons beyond his control, the seller (manufacturer) is obliged to provide him with a similar product of a different model within a month from the day the customer demands it. (brand, type of article, etc.) with the consent of the consumer. Goods of inadequate quality must be replaced with a new one, that is, with goods that were not in use. When replacing goods, the warranty period is calculated anew from the day the goods are transferred to the Consumer.


Settlements with the consumer in the case of purchase of goods of inadequate quality. When replacing goods of inadequate quality for goods of a similar brand (model, article), recalculation of the price of goods is not performed. When replacing a product of inadequate quality with the same product of another brand (model, article), if the price of the product to be replaced is lower than the price of the product provided in return, the consumer must pay the difference in prices. In the event that the price of the goods to be replaced is higher than the price of the goods provided in return, the difference in prices is paid to the consumer.


If a consumer presents a requirement for a commensurate reduction of the purchase price of the goods, the price of the goods at the time the consumer claims the markdown is taken into account, and if it is not voluntarily satisfied, at the time of the court’s decision to proportionately reduce the purchase price. Upon termination of the contract of sale, the consumer has the right to demand the return of the sum of money paid for the goods, as well as compensation for the difference between the price of the goods established by the contract and the price of the corresponding goods at the time of voluntary satisfaction of such a claim or, if the requirement is not voluntarily satisfied, at the time of the court . To consumers, to whom the goods were sold on credit, in the event of the termination of the purchase and sale agreement, the sum of money paid for the goods is returned in the amount of the loan repaid by the day of return of the goods of the loan, and the fee for the provision of the loan is refunded.
